Description:
The Baker Act was enacted to protect Florida citizens with mental illness by providing a system wide structure that would prevent abuse, provide treatment, and ensure the individual rights of each person. This course provides information on the history of the Florida Mental Health Act (Baker Act) and reviews the most important aspects of this historic Florida legislation. Those areas include express and informed consent, surrogate decision makers, voluntary admission, involuntary examination, involuntary placement, the role of law enforcement, Emergency Medical Treatment and Active Labor Act (EMTALA), special protection for voluntary elders, and rules governing the use of seclusion and restraints. Our goal for this training is to deepen your understanding of the Baker Act by providing information that will inform your application of its guidelines and rules in a way that promotes advocacy for the rights of individuals and the use of best practices.
